1. About MisterWhy

MisterWhy Rewards is a customer loyalty and promotional marketing platform operated by MisterWhy Enterprises LLC (https://misterwhy.co). We provide retail stores with tools to run loyalty rewards programs and send promotional SMS messages to customers who have opted in at the point of sale.

By using MisterWhy — whether as a store owner or as a customer who has entered their phone number on a MisterWhy-powered kiosk — you agree to these Terms of Service.

2. SMS Consent & Opt-In

By voluntarily entering your phone number on a MisterWhy-powered in-store kiosk, you consent to receive promotional SMS text messages from the retail store at that location. The following disclosure is presented to every customer before their phone number is accepted:

“By entering your number, you agree to receive promotional texts from this store. Msg & data rates may apply. Reply STOP to opt out.”

  • Message frequency varies by store.
  • Message and data rates may apply.
  • Reply STOP at any time to opt out of future messages.
  • Reply HELP for help or contact support@misterwhy.com.
  • Only customers who voluntarily enter their phone number on the in-store kiosk receive messages.

3. Rewards and Promotions

MisterWhy Enterprises LLC provides the platform technology only. MisterWhy is not responsible for the rewards, offers, or promotions offered by individual retail stores, nor for the fulfillment of any rewards. All reward-related inquiries should be directed to the store where you participated.

4. Store Owner Responsibilities

Retail stores using the MisterWhy platform are responsible for:

  • Obtaining proper customer consent before collecting phone numbers.
  • Ensuring their promotional messages comply with applicable laws, including TCPA and CAN-SPAM.
  • Fulfilling any rewards or promotions they advertise through the platform.
  • Maintaining accurate and up-to-date customer opt-out records.

5. Disclaimer of Warranties

The MisterWhy platform is provided “as-is” without warranties of any kind, express or implied. We do not guarantee uninterrupted availability or error-free operation of the service.

6. Limitation of Liability

To the maximum extent permitted by law, MisterWhy Enterprises LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform or participation in any store promotion.

7. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.
